These Terms of Use ("Terms") are the agreement between you and Maitora ("Maitora", "we", "us"), the provider of the Maitora app and its content (the "App"). By downloading or using the App, you agree to these Terms. If you don't agree, please don't use the App. This document also serves as the End User License Agreement (EULA) for the App.

1. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use one copy of the App on Apple-branded devices that you own or control, for your own non-commercial, personal wellbeing use, as permitted by the App Store Terms of Service and the Apple Licensed Application End User License Agreement (the "Standard EULA"). Where these Terms and the Standard EULA conflict, the more protective term for you applies, and Apple's Standard EULA governs the points it requires.

You may not copy, modify, reverse-engineer, decompile, rent, lease, lend, sell, redistribute, or sublicense the App except as expressly permitted by these Terms or applicable law.

2. Wellbeing, not medical advice

Maitora is a wellbeing and mindfulness tool — not a medical device, diagnosis, treatment, or a substitute for professional care. Its content (meditations, breathing exercises, affirmations, sleep stories, mood reflections, and Mitra's messages) is for general relaxation and self-reflection only.

The App does not provide medical, psychological, or therapeutic advice. Always seek the guidance of a qualified health professional with any questions about a medical or mental-health condition. Do not use breathing or movement exercises in situations that require your full attention (for example, while driving), and stop any exercise that causes discomfort, dizziness, or pain.

If you are in crisis or may harm yourself or others, do not rely on the App. Contact your local emergency services or a crisis line immediately. Mitra includes gentle prompts to seek human help, but it cannot and does not provide emergency or clinical support.

3. Mitra & on-device AI

Mitra and certain content (such as generated guided meditations, sleep stories, affirmations, and reflections) are produced using on-device artificial intelligence. AI-generated content can be imperfect, incomplete, or unexpected, and is offered "as is" for relaxation and reflection only. It is not professional advice, and you are responsible for how you choose to use it. Availability of AI features depends on your device and operating system.

4. Maitora Pro & subscriptions

The core App is free to use. Maitora Pro unlocks additional features and is available as an auto-renewable subscription or a one-time purchase, sold through Apple's App Store:

Prices are shown in your local currency and may vary by region, by Apple's foreign-exchange and tax rules, and over time; the price shown in the App at the time of purchase governs.

Billing & renewal

Free trials

If a free trial is offered and you start one, any unused portion of the trial is forfeited when you purchase a subscription. If you don't cancel before the trial ends, it converts into a paid subscription at the stated price.

Refunds

All purchases are processed by Apple, and refunds are handled by Apple under its policies — we cannot directly process refunds for App Store purchases. To request one, use reportaproblem.apple.com. Where the law gives you a statutory right to cancel or a refund, that right is unaffected.

Restoring purchases

You can restore an active subscription or your lifetime purchase on a new device with the same Apple ID via the "Restore Purchases" option in the App.

5. Your content

Photos, videos, journal entries, recordings, affirmations and other material you add ("Your Content") stay on your device; we never receive or store them. You are solely responsible for Your Content and for ensuring you have the rights to any media you import (including music and photos). You retain all rights you hold in Your Content. You're responsible for keeping your own backups — the App provides an export feature for this purpose.

6. Acceptable use

You agree not to misuse the App, including by: using it for any unlawful purpose; attempting to disrupt, probe, or circumvent its security or licensing; using it in a way that infringes others' rights; or importing content you do not have the right to use. The App is intended for personal, non-commercial use.

7. Intellectual property

The App, including its software, design, text, graphics, the "M + Om" mark, the Maitora name and wordmark, and all related content (other than Your Content and Apple's or third parties' materials), is owned by Maitora and protected by intellectual-property laws. These Terms grant you a license to use the App, not any ownership of it. "Maitora" is a trademark of its owner. Apple Health, Apple Watch, Apple Intelligence, Siri, and the App Store are trademarks of Apple Inc.; their use here is descriptive only.

8. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that any content, reminder, or AI output will be accurate or suit your needs. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, in no event will Maitora be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App. To the extent we are found liable, our total aggregate liability is limited to the greater of the amount you paid for the App in the 12 months before the claim, or US$50. Nothing in these Terms limits liability that cannot be limited under applicable law. This section does not affect the medical/wellbeing disclaimers in Section 2, which you acknowledge and accept.

10. Acknowledgement regarding Apple & the App Store

This Section applies to your use of the App obtained through Apple's App Store. You and we acknowledge that these Terms are between you and us only, not with Apple, and that Apple is not responsible for the App or its content. Specifically:

11. Changes & termination

We may update the App and these Terms from time to time. When we make material changes to these Terms, we'll update the effective date above and, where appropriate, note it in an app update. Continuing to use the App after changes take effect means you accept the updated Terms. We may suspend or end the App, or your license, if you materially breach these Terms; you may stop using the App at any time by deleting it.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles, and the courts located in India will have jurisdiction, except where mandatory consumer-protection laws of your country of residence give you additional rights or require a different forum. Nothing here deprives you of the protection of mandatory provisions of your local law.
